2) Acceptance & Apple App Store
By downloading, installing, accessing, or using HeartLink (the “App”) or any related services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
Apple terms. If you downloaded the App from Apple’s App Store, your use of the App is also subject to Apple’s applicable terms and usage rules. These Terms govern only your relationship with Couple Space Inc., not with Apple.
Acknowledgement. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the Service. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App (including product liability claims, claims that the App fails to conform to legal requirements, or claims arising under consumer protection law). Nothing in this section limits any rights you may have under applicable law that cannot be waived.
Third-party beneficiary. Apple (and Apple’s subsidiaries) are third-party beneficiaries of these Terms and may enforce these Terms against you.
3) Eligibility
Minimum age: 13 (or the minimum age required in your jurisdiction). HeartLink is not intended for children under this age. If we learn that an account belongs to someone under the applicable minimum age, we may suspend or terminate the account and take steps to delete associated personal information, subject to legal and technical constraints.
4) Accounts & Security
Account required. You may need an account to use some or all features of the Service. You agree to provide accurate and up-to-date information and to keep it current.
Security. You are responsible for safeguarding your device and account access (including any verification codes, link codes, or sign-in methods) and for all activity that occurs under your account. Do not share link codes with anyone you do not intend to link with.
Unauthorized use. If you believe your account has been compromised or used without authorization, contact us at support@couplespaceinc.com as soon as possible.
5) Partner Linking & Shared Couple Space
HeartLink is a private, two-person experience and not a public social network.
Linking consent. You may link your account with another person using a link code or similar mechanism. You represent that you have that person’s consent to link, and that you will not attempt to access or link with accounts you do not control or have permission to link with. If we believe you linked without permission, we may disable the connection, suspend your account, and take other action under these Terms.
Shared visibility. Once linked, certain content and activity within the couple space may be visible to your linked partner, such as quiz answers, memories, photo answers, and saved heartbeat recordings (including titles and replayable representations). Visibility rules and features may change over time.
Your responsibility. You are responsible for what you upload, save, or share through the Service. We are not responsible for actions your partner takes with content they can access, including screenshots, screen recordings, or saving content to their device.
Ending a connection. Depending on the version of the Service, you may be able to end a couple connection by deleting your account and/or by contacting support. When a connection ends, access between linked accounts will be disabled. We may delete couple-scoped content from our systems as described in the Privacy Policy. We cannot remove copies your partner already saved or captured (for example, screenshots).
6) Heartbeat Feature — Health & Safety Disclaimer
HeartLink’s heartbeat feature is for connection/entertainment and general wellness purposes only. HeartLink is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.
Do not use HeartLink to make medical decisions or respond to emergencies. If you believe you have a medical emergency, contact local emergency services.
Heartbeat estimates may be inaccurate or unavailable due to factors such as movement, contact quality, lighting, device differences, or environmental conditions. Do not use the heartbeat feature while driving or performing activities requiring full attention. Stop using it if you feel discomfort, anxiety, or distress.
7) User Content & Acceptable Use
User Content: “User Content” includes content you create, upload, submit, transmit, or store through HeartLink (for example: quiz answers, photos, profile information, avatars, saved items, and heartbeat recording titles/notes if supported).
Ownership: You keep ownership of your User Content.
License to operate the Service: You grant Couple Space Inc. a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, reproduce (for technical purposes), process, format/resize, transmit, display, and otherwise use your User Content solely to provide, maintain, secure, and improve the Service and to make your User Content available to you and your linked partner within the Service. You also grant us the right to access User Content as reasonably necessary to provide support, address safety issues, enforce these Terms, and comply with law.
Your responsibility: You represent that you own or have the necessary rights to your User Content and that sharing it through the Service does not violate any laws or third-party rights.
Prohibited use. You may not use the Service to:
(a) harass, threaten, abuse, bully, or intimidate others;
(b) post hateful or discriminatory content or encourage violence;
(c) exploit, sexualize, or endanger minors;
(d) impersonate others or share private information without permission;
(e) upload illegal content, infringing content, or content that violates others’ rights;
(f) upload malware, viruses, or harmful code;
(g) attempt unauthorized access, misuse link codes, scrape data, or disrupt the Service;
(h) reverse engineer the Service except where permitted by law; or
(i) use the heartbeat feature to make medical claims or to diagnose, treat, or monitor medical conditions.
Enforcement. We may remove content, restrict features, or suspend or terminate accounts if we believe it is necessary to enforce these Terms, comply with law, or protect users or the Service.
Export and prohibited use: You may not use the Service if you are prohibited from doing so under applicable laws, or to violate export control, sanctions, or other applicable regulations.
8) Reporting, Moderation, and Safety (UGC)
Users may upload content (for example, photos or text) within the couple space.
Reporting. You can report objectionable content or abuse by using the in-app “Report a problem” feature (if available) or by emailing support@couplespaceinc.com. Please include your user ID, screenshots (if available), and a description.
Blocking / restricting access. To help prevent abuse, the Service may allow you to block or restrict interaction with a linked user (for example, stopping sharing or disabling access between linked accounts). Availability of these controls may vary by version.
Review & actions. We may review reports and take action as reasonably necessary, including removing content where feasible, restricting features, suspending or terminating accounts, and/or disabling access between linked users, subject to applicable law. We cannot guarantee that all objectionable content will be prevented or removed immediately.
Prevention. We use policy enforcement and technical measures intended to help prevent and address objectionable content and abuse.
9) Paid Features & Subscriptions (iOS)
Some features may be free and some may require payment.
Apple billing: Subscriptions and in-app purchases on iOS are processed by Apple using your Apple ID and Apple’s in-app purchase system. We do not collect or store your full payment card details.
Auto-renewal: Auto-renewable subscriptions renew unless canceled before the end of the current billing period.
Trials / promos: TBD (only if offered). (say we may or may not distribute it)
Manage / cancel: You can manage or cancel subscriptions through your Apple ID subscription settings. “Restore Purchases” availability in-app: TBD. (Ye we will add that, add a normal general placeholder)
Refunds: Refund requests are handled by Apple under Apple’s refund process.
Price changes / taxes: TBD. (idk what to say here, yes we may in the future).
10) Termination & Account Deletion
You may stop using HeartLink at any time and uninstall the App.
Our rights. We may suspend or terminate your access to the Service if we reasonably believe: (a) you violated these Terms, (b) your use creates risk or harm to users or the Service, (c) we must do so to comply with law, or (d) it is necessary to protect the integrity or security of the Service.
Account deletion and couple space. If you delete your account while linked, the couple connection will end because the Service disables the link between accounts. When a connection ends, couple-scoped content may be deleted from our systems (for example, couple quiz answers, couple heartbeat recordings, couple photo answers, and related saved items), subject to technical and legal constraints.
Impact on the other partner. If your partner keeps their account, it may remain active, but they may lose access to the deleted couple space and its content. We are not responsible for actions your partner took with content they previously had access to (including screenshots or saving content to their device).
Retention. We may retain certain information as required by law or for legitimate business purposes such as security, fraud prevention, and backup, as described in the Privacy Policy.
